Explosives have always been regulated differently than ordinary military equipment in common use by the people. No nukes or smart bombs, but modern pistols and assault rifles are protected. The Framers were aware of technological advancements. See Article I, section 8, clause 8, which authorizes Congress to draft patent and copyright laws.

I dont get the big deal. people have a difference of opinion. so what.

I support allowing people to get guns for their safety, but let's not pretend there is only one side to this debate. people dont need fucking elephant guns. people do not need to walk around main street with a rifle. the average citizen is a tard. i guarantee your facebook feed is supplied with dozens of them this second.

is Morgan on CNN or some such?

tho he was 'owned' in conversation, I hope the lady doesn't think we should all have laser guided missles

Laser guided missiles aren't exactly 'bare-able arms'...

Let's see what the Supreme Court has to say about bearable arms:

"The signification attributed to the term Militia appears from the debates in the Convention, the history and legislation of Colonies and States, and the writings of approved commentators. These show plainly enough that the Militia comprised all males physically capable of acting in concert for the common defense... And further, that ordinarily, when called for service these men were expected to appear bearing arms supplied by themselves and of the kind in common use at the time."

United States v. Miller, 307 U.S. 174 (1939).

Why is it we hear all about these ancient, sacrosanct documents be it the Constitution or the bible, but then people are happy to take modern rulings on them when they're in favor of their position.

I don't understand why there aren't MORE and more amendments, clearly that was the way in which the founding fathers inteneded as can be seen by the number of early amendments. They'd be rolling in their graves at a time with vast technological upheavel yet few corresponding changes to the Constitution.

There aren't more amendments because parts of the Constitution are purposefully open-ended, allowing the Court to fill in.

jasonhightower -  It's an ignorant, short sided perspective. Lets just ignore all the root causes and blame the guns. Hell, look at Sweden... They issue guns to all men for military reasons, arming the country in essence, and they have one of the lowest crime rates in the world. Phone Post

I think you mean Switzerland.

One of the clearest things about the way the Founding Fathers set up the Constitution is that they expected it to evolve over time in concert with social & technological change. IMO most of them would be pretty disappointed to find people 200+ years in the future quibbling over their word choices while missing any sense of a wider context.

YES!

The US constitution (and without political connotations) was one of the most progressive documents ever written. I feel that approach has changed remarkably. Particuarly over the last 30 years - which basically correlates with the advancement of religious neo conservatism.

ksac - So I can has a nuclear weapon then?
Seems like a bearable arm to me... Let me know how it works out and then ill try Phone Post

Well, it seems to illegal to own one. According to this woman, it shouldn't be so. I may need to protect myself from the government (big argument made against gun control) using the the "same weaponry".

Basically I'm saying the argument is far from being a simple one.

I beleive a nuke is needed only for national defense otherwise it would be mutual destruction if used domestically. If our government turned against the people, though we should be equally armed in order to resist a rogue government.

I agree. This is the way to go about enacting gun control if you're the type who wants to. It would be really easy to legally take all the guns from everyone in the country. Just get 38 state legislatures to call for an amendment or hold a national convention. If enough Americans agree it will happen.

The wrong way to go about enacting gun control is to ignore the Constitution or make up things about it that aren't there. If Morgan wants guns gone he should quit misrepresenting the document and work to change it. Phone Post

Um... Not really. The first 10 amendments were a requirement by several states in order for them to adopt the Constitution. After those amendments become few and far between.

Wrong. They set up an amendment function so that the document could change over time. They did not intend for their clear words to be interpreted differently. Phone Post

All this "our founding fathers said" bullshit really has to stop.

Should a person be able to have a gun in their own home? Sure why not.

But imo there should be strict regulations in place, and mental health checks should be a must.

I don't know much about gun laws in the states so i'm kind of just talking out of my ass, but from what i gather they are rather easy to obtain.
