A: A man is driving through town. His car jumps the curb and hits a newspaper stand. A few scared pedestrians, but nobody is hurt. Turns out the man was drunk. What would the legal consequences be for him? B: A man is driving through town. His car jumps the curb and hits a newspaper stand. A few scared pedestrians, but nobody is hurt. Turns out the man had a diabetic stroke. What would the legal consequences be for him? |

A: He would get arrested for a DUI. B: He would probably still get arrested for a DUI due to the fact that diabetic issues mimic alcohol very closely. I'd win both. |

A similar situation to B happened to a friend earlier this year, he had no legal consequences. |

Due to the fact that he is on his way to the hospital there will be a blood test, not breath. The State would make him hire a lawyer, spend lots of money, try to get a plea out of him anyway and then dismiss the case when the blood work came back negative. |

that's if he survives being arrested and thrown into the back of the patrol car while suffering from the effects of his stroke. |

I've had it happen. No medical alert bracelet, but cops arrested him after the paramedics said he was in a state of diabetic shock due to high blood sugar levels. |

i've actually run into this a few times, and diabetics act EXACTLY like combative drunks b4 they go coma. luckily, we were able to figure out what was wrong with them and get them medical attention in time. the tip off is the lack of alcohol smell for someone who is apparently staggering drunk/slurring words/swearing at you. instead their breath smells "sweet". distinctive, and you don't forget it. |
