Let's talk about Constitutional interpretation! Originalism is the theory that the meaning of the Constitution is fixed, at the time the particular section was ratified. The argument for originalism can be summarized as follows: the purpose of drafting a legal document is to reduce uncertainty regarding the obligations of the parties, and the Framers included an amendment process to allow for future changes. Others argue the Constitution is a living document, especially those clauses that are open-ended or ambiguous. Also, the plain text isn't always plain: who presides over the impeachment of the Vice President? Turning to gun control, Piers' statement isn't fact. The framers were well-aware of technological advancements. Several of them were inventors, and they enabled Congress to protect inventors. We don't limit the Bill of Rights to 18th Century technology. Imagine the outrage if the Court held that Freedom of the Press didn't apply to Twitter. On the other hand, the 2A doesn't protect the right to have any weapon whatsoever. The Court has been down that road, and established a test based on the text of the Constitution AND the historical context of the document AND the challenges of a changing society. |

I've never met anyone that thought it was a good idea to have unrestricted weapon access. Hell, the gun enthusiasts I've met seem to get uppity when others even have the material to make nuclear weapons (supported taking out Iraq because of claims to be making weapon-grade fissionable material). Most people draw the line somewhere and it's not at "same weaponry". |

you asked the question with an implied answer....so if the supreme court never ruled a canon (the most damaging weapon of their time) is illegal to own, why would they ever put a limit on it? |
