Ben-Ami Kadish was accused of providing the documents, including some relating to US nuclear weapons systems, to an Israeli agent, Yosef Yagur, who photographed them at Kadish's home. Kadish, who pleaded guilty to only one of the four espionage-related charges he originally faced, entered the plea at a New York court on Tuesday. He is set to be sentenced in February and could face a maximum of five years in prison and a fine of up to $250,000. However, a US prosecutor said on Tuesday that the government would not oppose a sentence that means Kadish will not serve time in prison, the Associated Press reported. Yagur has been linked in court documents to the case of Jonathan Pollard, a US citizen who is serving a life sentence for a 1985 charge of spying for Israel. Court papers say Kadish's alleged spying took place between 1979 and 1985, although he maintained contact with an Israeli consular official until this year. Israel has denied spying on the US after 1985. Classified documents The charges alleged that the Israeli consular official, identified in the indictment as "CC-1", gave Kadish lists of classified documents to obtain from the US Army's Armament Research, Development, and Engineering Centre at the Picatinny Arsenal in the state of New Jersey. The documents included information about nuclear weapons, fighter jets and the US Patriot missile air defence system, prosecutors say. Kadish, who worked at the arsenal from 1963-1990, kept in touch with CC-1 via telephone and email and met the official in Israel in 2004, authorities said. "CC-1" had left the US in 1985 and has never returned, the US authorities said.

I’ve heard that the US has a special agreement with Israel permitting people to be dual US/Israeli citizens. Is this true? No. It just happens that Israeli citizenship law does not require renunciation of one’s old citizenship in order to become a citizen of Israel. In this regard, Israel is really treated no differently than Canada, the UK, France, or other countries which permit people to become citizens without giving up their old status. As best I have been able to determine, the US does not have any sort of treaty facilitating dual citizenship with any other country. Dual citizenship arises, not out of explicit bilateral agreements between nations, but because each country makes its own laws respecting who is or is not its citizen, often without regard for whether a given person is considered a citizen by more than one country at once. It is interesting to note that Israel’s “Law of Return” (under which any Jew may immigrate to and become a citizen of Israel) confers Israeli citizenship automatically, without the immigrant having to apply for it, attend any ceremony, or swear any oath of allegiance. The Israeli law may originally have been written this way to encourage American Jews to move to Israel; they could, in theory, argue that they had not explicitly requested Israeli citizenship and were thus still entitled to keep their US citizenship. (Note that Mr. Afroyim, subject of Afroyim v. Rusk, was alleged to have lost his US citizenship, not because he had become an Israeli citizen, but because he had voted in an Israeli election.) During the late 19th and early 20th centuries, the US ratified a series of citizenship treaties (the “Bancroft treaties”, named after American diplomat George Bancroft). The intent of these treaties was to prevent dual citizenship by providing for automatic loss of citizenship by foreigners who obtained US citizenship, or by Americans who obtained foreign citizenship. As a result of the various Supreme Court decisions on dual citizenship, however, the Bancroft treaties became legally unenforceable, and all of them have by now been formally abrogated by the US. One of these treaties (the one with Sweden) is mentioned in the Supreme Court’s decision in Perkins v. Elg. |

The Law of Return in Israel is just that. After the Holocaust Jews from all over the world were told they had somewhere to go. Not all countries were allowing them in. The reason they don't have to renounce their original citizenships now is that if the Jews are displaced YET AGAIN, from Israel, they'll have somewhere to go. |

I'm going to leave my initial post in, but I was going to retract it on the basis that after reading a couple of articles I don't think it's cool at all politicians carry dual citizenship. I'll say that it's more of an issue than I'm prepaired to debate about. But I'll say that given the history of Jews in the world being tossed around an answer should be looked at without such conspiracy lenses. |

This is such a cunnundrum for me. One side of me says no duel citizenship due to spying issues and leaks in info to Israel. The other realizes it's not just Jews wanting Israel to succeed it's Christians too. Jews don't need dual citizenship. They can move to Israel any time they want due to "Law of Return". Who would need active duel citizenship would be evengelicals. They want to influence Israel in a big way. They want it to succeeed as do the Jews but they want to transform it for their own purposes. Without getting into it what's the answer? US gives more to Palistinians and Egypt then Israel who steal the money, take it and run, Israel however reinvests it into it's countries development and security. There are more Christian politicians then Jewish, way more. The US is in the business of helping out Israel and calling it a friend but I'm not sure that's because of the Jews, it's moreso the Christians. The problem is Christians want to change it from a Jewish land to a Christian one. That maybe the reason Jewish politicians are willing to sacrifice their political lives and go to jail for Israel when Christians don't have to. They steer the ship, so to speak. Israel may be better off buying from Soviet Union, they'd stand behind Israel taking control of the land and their weapons are cheaper. But that's a battle between socialism and capatilism and capatalism wins. So should Jewish politicians hold duel citizenship? They don't need to they have it to live in Israel they can for just being Jewish anyway, no duel citizenship necessary. The question is should Jews serve public office in the US? That would be discrimination. And as long as there are Christians lobbying for Israels success who'd need dual citizenship to live there then there will be Jews doing the same thing. I just think it's Christian smackdown on Jewish politicians to get them out. Without Jewish politicians lobbying for a Jewish Israel there will only be Christian Lobbyists Lobbying for a Christain Israel. I think there needs to be MORE Jews holding public office to balance out the playing field if not tipping in in Jewish direction regarding Israel (I am Jewish). As long as they're doing good work for the US it's just Christian dominated smackdown. I'm sure they're not getting caught but they're guilty of similar heanous stuff. |

Pollard was an American Navel Inteligence Analyst. He wasn't handing vital American information to the Isrealis like your suggesting. Netanyahu is applauding him a hero because Pollard gave them information America was deliberately witholding vital to Israels security. According to a 1983 Memorandum of Understanding between the two countries Israel was legaly entitled to this information. The exact quotes being submitted as reasons behind Pollards actions were "Mind your own business" and that "Jews get nervious talking about poison gas, they don't need to know." Pollard never had a trial about it yet sits in Jail. Pollard was never indicted for harming the U.S. in any way, not treason only for passing classified information. Your vulgarity & disrespect is discusting and it shows your ignorance when you don't even know the facts of the case. |

Last week, the Knesset took up the issue of Jonathan Pollard, the American Jew who has been serving a life sentence for spying on the United States on behalf of Israel. Knesset Speaker Benjamin Ben-Eliezer praised the spy as a “true Zionist.” Many members joined the 100,000 Israelis who signed a petition calling for Pollard’s release. Jerusalem Mayor Nir Barkat agreed and said he would nominate Pollard for the prestigious Jerusalem Freedom Award. Pollard’s supporters are hoping this campaign on the eve of President Obama’s trip to Israel will bring attention to the case and lead to his freedom. But they are almost certainly mistaken. In today’s Haaretz, the paper’s Barak Ravid quotes a “senior American official” as saying that the latest round of public advocacy in Israel on behalf of Pollard is having no impact on President Obama. Though the administration is resigned to being subjected to numerous appeals to release the former U.S. Navy analyst who has been in jail since 1985, none of it is likely to persuade the president to grant clemency to Pollard. Indeed, as the official makes clear, the more Israelis and some American Jews treat the spy like a hero, the less likely Obama or anyone else in a position of authority in Washington is to listen to their appeals. That’s a hard concept for those who are trying to free Pollard to understand but if they are to ever succeed, they must start trying. As I wrote in the March 2011 issue of COMMENTARY in an in-depth analysis of the case on its 25th anniversary, both sides of the long running argument about Pollard have exaggerated their positions to the point of caricature. Those in the U.S. security establishment have wrongly tried to blame Pollard for American intelligence setbacks at the hands of the former Soviet Union in an effort to justify their desire to continue to make an example of him. But Pollard’s backers have also inflated the value of the espionage that he committed on behalf of Israel while also trying to ignore the far more serious damage he did to the Jewish state by souring relations with its sole superpower ally. |

Irrespective of these exaggerations, Pollard committed a crime for which he deserved serious punishment. But after more than 27 years in jail the case for mercy for the spy is stronger than ever. As I wrote two years ago, his sentence was disproportionate to that given any other person who spied for an ally as opposed to an enemy or rival nation. Nor is there any conceivable security justification for his continued imprisonment. But the biggest mistake that his supporters have continually made over the years is to think that his freedom will ever be won by efforts that cast him as a martyr. It was Pollard’s own foolish boasts along those lines in a “60 Minutes” interview and in discussions with Wolf Blitzer (the CNN star was then a Jerusalem Post reporter) that caused the government to trash the plea bargain agreement with the spy and led to his draconian sentence to life in prison. Praise from the Knesset and awards from the city of Jerusalem merely repeat these mistakes. What Pollard’s fans don’t understand is that lionizing the spy merely increases the desire of the U.S. security establishment to keep him in prison to set an example that spies are punished, not set free to play the hero. The vengeful attitude toward Pollard may stem in part from hostility to Israel by some in Washington. But it’s hard to blame them for resenting a campaign that treats a U.S. Navy employee who broke his oath and did real damage to the United States as somehow deserving praise. But the pro-Pollard Jews just can’t seem to help themselves. One of the main lessons of 20th century history for Jews was that they couldn’t afford to be silent in the face of a threat or injustice. Such silence or a reliance on traditional modes of quiet diplomacy failed them in the greatest crisis of modern Jewish history during the Holocaust. A desire not to make the same mistake helped inspire the movements to free Soviet Jewry and to support Israel. It inspired in many Jews an understandable contempt for behind-the-scenes diplomacy or reticence on any issue. But it was that discredited strategy of quiet outreach rather than aggressive advocacy that was always the only formula to help free Pollard. Had the issue been framed solely on the concept that Pollard was a misguided soul who erred but deserved mercy, he probably would have been out of jail a long time ago. But the attempt to cast him as an American “prisoner of Zion” merely strengthened the hands of those U.S. officials who have always been the roadblock to clemency. At this point, it’s hard to imagine any circumstance in the immediate future that will lead Obama or his successor to free Pollard. But if there is to be any hope, it must begin with the spy’s supporters dropping any mention of anything but a desire for mercy for a man who has already been severely punished. If they ever want to see him freed, there must be an end to awards or rhetoric about his commitment to Zionism. |
