i looked this up online and still was confused. so lets say you sell a car to a friend and have a witness and agree to have it paid off in 6 months. they dont pay, can you sue them without a written contract? |

You can sue anyone for anything you want. Are you asking if you will win a lawsuit, because it might be hard to find someone that will give you a definitive "yes." What was the price for the car? |

Verbal contracts are generally enforceable as long as you can prove them and they don't violate the statute of frauds. A car probably sells for over $500 so under the UCC would need to be in writing. That amount may be different depending upon which state the transaction occurred. Of course even then we would need to look at reliance issues and you may still be able to recover. |

UCC (statute of frauds) usually only applies to merchans so sue away. |
