For some reason as long as they call it a parody it falls outside of copyright protection. I don't know the specifics but someone here might.

There are actual legal standards they have to meet in order to meet the definition of parody. Essentially the argument is they make a new work that "comments" on the original work. This is supposed to allow for cultural critique and blah blah.

Obviously there are questions on if these porn things actually are a commentary, but that's how they get by. Marvel & DC might actually have a decent case if they decided to sue, but there are cost to benefit considerations.

Plus I don't imagine they want to make that many people mad by messing up things with a lawsuit. The comic book and porn crossover audience has to be close to 100%.

You also have to consider that suing them also gives the porn producers free publicity. I doubt that the big 2 are happy about stuff like this, but don't want to make more people aware of it than the ones that already do.

Thanks. I think I heard about that one. I'm amazed they didn't use Mockingbird as well. Her costume lends itself easily to porn parodies.
