Call for Victim Impact Statement in Mask's death

by Kaya Lewis | source:

I just want each of you to know the court date of March 2, 2010, is approaching. Please join the family at 8:30, 700 W. Civic Center Dr, Santa Ana, in front of the court room C-57. We usually meet in front of the D.A.'s office located on the second floor just before our hearing.

For the past year Charles' Attorney and myself have repeatedly come before the Judge, wanting our case sent to trial. Jeffrey David Kirby, has changed his Attorney several times and has not appeared, at least twice. T

If  you, friends and/or family members cannot attend, please send your Victim Impact Statement re: 09HF0445 to Deputy District Attorney, Jason Baez at

We must make the Judge aware of our feelings, regarding this multiple DUI offender, Jeff Kirby.  Kirby has manipulated the court and refuses to own up to what he has done.  By his own statements he blames my brother, Charles. He totally ignores the crime scene investigation, which noted Kirby T-boned Lewis not once, but twice.  Causing my brother to smash into the light pole and die.

The trial for this case has ended. It is now up to the Jury. Will report back with the verdict once it has been given.

I wasn't there and I don't know any facts other than what I've read but what I do know is that a "high rate of speed" by a a police officer can mean anything. For all we know, Mask could have been going the speed limit and the cop just saw a Ferrari and a Porche and assumed by the sound of their engines that they were racing. It's not even far fetched to think that maybe Kirby saw a crazy looking dude driving a better car than his and sped up on him trying to race. As for how he could have T-boned Mask twice, Kirby was driving alongside Mask when his car hit a divider and turned sideways, hitting Mask and throwing him into a spin where Kirby then hit him a second time and knocked him into the pole that split the Ferrari in half. Considering that a Ferrari is basically made out of paper mache, even a crash at 50mph would be enough to do considerable damage. So, yeah, it's possible that Mask was innocent in this. He could have been on his way home and some drunk prick decided to race and ended up slamming into him. It's also possible that Mask pulled up to the drunk guy and instigated the whole tragic event. Unfortunately, the only people who know for sure were the people there so there's no way to get an unbiased opinion of what happened that night. While we can't know who instigated it, what we can do is work with what we do know- A drunk guy with previous DUI convictions was involved in a wreck that caused the death of another driver and then fled the scene. That alone should be enough to warrant our scorn.

Did you actually read the OP? It invites this kind of discussion simply by its wording.

"Whats the point of going to a forum filled with alot of people that Loved him and harping over and over on it." Well, first off, I think you misuse the word "love". Few people on here even knew the man aside from a quick hello and a few words. Regardless, the point is that Lewis was an icon for people around here... Mr. American, Mr. Arrogant, Mr. In Ya Face... and that attitude that he put forth is extremely dangerous and it's not something one should aspire to emulate.

I think everyone knows that Mask had a responsibility in his own death for driving like he did. Whats the point of going to a forum filled with alot of people that Loved him and harping over and over on it. Make you feel good?

It's a sad situation. Kirby should have to pay a price. It's not 100% his fault but you have to ask yourself, if Kirby wasnt there, would Charles still be alive? Did Kirby's actions contribute to Charles death? Yes!

Not trolling, quoting an article that was posted on this thread in regards to the police accounts of what actually transpired. Regardless, Lewis was acting reckless and irresponsible and could've ended up killing others. Driving a Ferrari at 100mph... American, Arrogant, In Ya Face, and deadly. He turned his car into a multi-ton missile.

You're quoting an article that came out 48 hours after the accident AND contradicts itself by stating "all signs point to street racing" only a few lines before stating "it's still too early to tell if an ill advised street race killed Mask." Are you a troll or what? Be honest.
