Kizer details next steps for Diaz

Keith Kizer, Executive Director of the Nevada State Commission recently joined SiriusXM Fight Club Radio to discuss Nick Diaz testing positive for marijuana at UFC 143, for the second time. For his first offense, in 2007, Diaz was stripped of a highlight reel win over Takanori Gomi, fined $3,000, and suspended for six months.

The precedent for a second positive test is a one year suspension, although that is far from determined thus far. Kizer detailed the steps Diaz will go through.

"The complaints have been mailed to him. He'll receive the complaint by mail and he'll have 20 days upon receipt to file an answer.

"With the complaint, those are just allegations at this time. There's been no finding against him. He'll have ample opportunity to respond to the complaint and then we'd put it on for a hearing at a time that works for him as well as the Attorney General's office.

Probably April based on past disciplinary complaints and at that time, there'll be a hearing before the full commission and then they make a decision at that time and if they found the athlete guilty, they'd then impose whatever discipline they felt was appropriate."

LOL at your entire statement. When Diaz signed the agreement for the fight, he ALSO SIGNED AN AGREEMENT TO BE TESTED, and in that same agreement listed the penalties for failing said test. Your legal advice would get people sent to jail stop giving it.

They should accept that he uses it medicinally and they their test doesn't test for intoxication at the time of the fight. They have no jurisdiction into what Diaz does in his private time. In fact, I'd say Diaz could likely sue them for intruding into his personal life and being a detriment to his livelihood. There should be no suspension and Diaz should be fighting Condit in a rematch.It also bothers me that the commission is allowed to put off Diaz being able to train or sign for a fight until April at the least. The rules should have been changed long before this, and facing this issue should now should cause change in not only how cannabis is perceived, and tested for, in MMA but at a federal/legislative level as well. There's no reason for it to be illegal. The government and athletic commissions shouldn't be able to dictate what we do in our personal lives. If weed is a PED or not it should be up to each individual if they want to use it as it is relatively harmless. Bruce Lee used it.It should simply be viewed as what it is: a herbal supplement.Not a chemically created steroid or performance enhancing drug. It's not going to make you sweat vaseline(see:GSP).

Does Nick even check the mail? Seems like an awful lot of responsibility and one of those things that's hard to remember anyway. I'm thinking Kieth will need to make a house call and deliver the message in person.

oh come on...Nick has been his own worst enemy ever since I've been following him in MMA. 99.9999999% of his problems are a direct result of stupid things he's done.

If DIaz gets a good lawyer he can decrease alot of the potential penalties (suspension time and money).... but knowing him, his crew, and the brilliant Cesar Gracie this will likely turn into an even bigger cluster of a mess.
