I don't post on the LegalGround much, but though you all might be interested in reading an amicus brief I cowrote in the DC gun case which will be argued before SCOTUS next month.  We represented a group of retired military officers in support of respondents (Heller).  We filed it on Monday.

I met the lead attorney for the respondents. I live in DC but I will be gone a few months after the decision comes down. Still I hope they uphold Silberman's (he teaches at my school) decision. Though I didn't agree with everything he wrote. I think he dismisses the militia clause too easily with tortured reasoning. I am a gun nut btw.

Oral arguments were today.  Our brief was mentioned several times, once by Alan Gura (attorney for Heller) and twice by Justice Breyer, who complimented it before trying to twist the arguments to his own ends.

It looks like the individual rights view will prevail, although what standard of review will be applied is not clear.  The Chief even hinted that he might avoid applying a standard of review entirely.

"Which argument?" The oral argument. Both sides ended up arguing almost the same thing.
