Client charged with resist, delay, obstruct and damage to state property. Background facts: client was running from the police and the police officer's badge fell off causing the officer to step on it and the badge got bent. Bflex closing: Your honor, we conceded to the resist, delay, obstruct charge. However, regarding the damage to state property, my client was not the proximate cause of the injury. It is not foreseeable that an officers badge will fall off causing him to step on it. There is an uncharged culprit in this. The culprit is gravity. Gravity is guilty of damaging state property, my client is not. Verdict: Guilty resist delay obstruct. Not guilty as to damage to state property. The Judge actually stated that gravity was found guilty.
