Courts have already heard the 1A challange and ruled that the "fighting words" doctrine applies. Not protected speech in most cases.

They will eventually overturn that IMO, but yeah I forgot about that. The worst part about Chaplinsky is that there are now dozens of people on the OG/UG that think you can legally strike a guy if he uses "fighting words" against you (and nothing else--no assault). *bangs head against wall* No amount of case citations will convince them otherwise. Some of them are police as well.
