I work for a restaurant in south carolina and make 75$ a day salary(shit pay i know). I work 9 hours a day with no breaks 6 days a week. I have yet to see a cent overtime. I know some occupations are exempt from overtime like managers and independent contractors. I don't set my own hours and have no managing responsibility so I don't see how i would be exempt.

In KS, anything over 45 hrs a week they "should" pay compensation. Of course, most of these are SALARIED employees that never ask for it because they won't have a job if they do.

You are entitled to overtime under the federal FLSA. Contact the Department of Labor office in your area and talk to them about it.

When I managed a restaurant 15 yrs ago the policy was anything over 4 hrs 30 min you have to give them a 30 min lunch break.
