i learned in law school that parents are not responsible for the intentional tort of their kids unless they provide the means for the tort...ca civil code does not jive

a friends 13yo daughter got caught shoplifting $6 worth of makeup

the store did not call the cops but made the father sign an acknowledgment of the theft and of CA civil code 490.5 which provides j&s liability for minor/guardian and allows damages of $50 to $500 plus costs

the store's attorneys are asking for a settlement of $306 to avoid further civil action

is a big drugstore chain going to mess with small claims court...or are they just bluffing to get the settlement?

No one here can really know the intentions of the store.

I know of situations where stores have followed through on actually filing suit in such cases.
