Was set for a little trial this morning on a wage and hour case I was defending. The other attorney wanted to discuss potential settlement before we got started. I explained how I could prove her client was lying, and that she was a scumbag in general. I told her that if the plaintiff dropped her claims, we would not sue her for malicious prosectution. It worked. Gotta love it when the other side quits.

Mailcious prosecution is the act of filing a claim that you know has no merit at all. So, if somebody files a meritless claim, and you win at the trial, you can then sue them for malicious prosecution and recover the attorneys' fees you had to incur in the first trial.
