"I was very disappointed," Gracie said on The MMA Hour. "Everyone knows he smokes marijuana medicinally in California. He has a legal right to do it in this state."

Gracie said he was the one who was informed of the positive test and passed along the word to Diaz, and that Diaz had thought he had stopped using marijuana for long enough before the UFC 143 fight with Carlos Condit, and had enough water pass through his system, that a test would come up negative.

"He was surprised he tested positive," Gracie said. "He does the same ritual every fight for the last five years. He stops it in time and he cleanses his system, works out like crazy, drinks a lot of water and purges his system of it."

Gracie said he thought Diaz's weight cut may have contributed to the marijuana metabolites staying in his system longer than usual. Gracie said the Diaz camp has hired an attorney, Ross Goodman of Las Vegas, who will help to appeal to the Nevada State Athletic Commission.

You mean the defense of "it is publicly fucking known that he gets legal medical marijuana from a doctor regularly for an undisclosed illness"?

I don't see why it should. Unlike steroids, cannabis is allowed outside of competition.

back to the subject:

He has consistently passed every test since 2009 and prior to it. Clearly he is not high for the event which should be the ONLY possible offense being discussed.

No one should give a flying fuck what this man does in his life. When it comes to the contract and being in the cage it is another thing entirely.

He was not high for the fight. That is the only thing that should matter. This whole circus over what Nick does in his life is utter bullshit.

I think he means the part about openly admitting to try and beat the test. I think most people understand thats kind of a silly thing to be worried about but when Diaz is standing in front of the commission defending himself then telling them that he does his best job to "fake out" the test for lack of better words, i dont think the commission is going to take that too lightlt....even if it is public knowledge that he smokes weed all the time.

I guess Diaz has nothing else to do for the next 12 months but fight it. Saying "I know I was doing it and I got caught (again), but I shouldn't have gotten caught" probably won't go over too well with the commission.

The commission will probably think that the first time they nabbed him and gave him a light punishment didn't teach him anything and the next punishment should be more, not less, severe.

i wonder how much was in the ua sample. most of the common detectors ($40@walgreens) that law enforcement use go hot at 100ng/ml iirc. no idea what the nsUc tests at

edit: i see a walmart tester that goes at 50ng/ml, and discussions suggest another method that will see @ 15ng/ml. buddy that was 5'8" 130 only needed a week every time for his p.o.

Exactly. This has nothing to do with what your opinions of marijuana are. Fact is, he's essentially admitting that he's trying to beat the test. It's not too smart.

I bet he was drugged by someone at Jackson's. Come to think of it we know Diego Sanchez has made public his past issues with the devils lettuce. Not much of a stretch to say maybe Diego had some left in a baggie from years ago, and that he rubbed it on Diaz somehow before the testing.

Shameful that Diego might have turned a friendly 1 on 1 backrub or deep full body rubdown with Diaz locked behind closed doors, into such a heinous act using Diego's special ganja oil.

I'm not sure how this works but how do you appeal when you more or less have said you are guilty ?? Do you say you tried to get it out of your system but it didn't work ?? Even so you are still guilty of not passing the testing requirements of NSAC. I don't see how you can get out of it, I'm a far cry from being a legal expert but haven't others tried this and failed miserably ?? Seems to me it will cost for the attorney and history says it won't help. Phone Post

In 2007 commission Chairman Dr. Tony Alamo said that while a result of 15 is considered positive, the NSAC has a threshold of 50 for athletes.

 Here is my take on what might be a possible argument that Diaz can make. First of all they don't know for certain one way or the other if he was high for the fight. Since they only check for metabolites in his urine it is not an acurate way to determine when the last time he smoked. What Diaz should be doing is providing (at his own expense through a Dr of the AC's chosing) a blood test to show he was not high on the night of the fight. He has a legal (in Ca) Rx to smoke in Ca, if the fights are there or other places he should prove he is clean leading up to the fight. Ask the AC's to give a realistic time table of when to cut the pot, 10 days, 2 weeks or whatever is reasonable to not "in danger" himself during the fight. 

It's not about trying to beat the system more than it is to take his meds so he can function outside of the fight. Just like if you have an injury and take Rx pain killers, they say you can't take them up to a certain point leadin up to the bout. This should be treated no differently imo.
