The Culinary Workers Union Local 226 has for years failed in its attempts to unionize the Station group of hotel-casinos in Las Vegas. Station Casinos, frequently named to Fortune's 100 best Companies to Work For, is owned by Frank and Lorenzo Fertitta, who are also majority owners of the UFC.

Although the UFC has nothing to do with culinary workers, and indeed provides a vast amount of union work at arenas across the nation, it has become a target of the union.

Anti-UFC steps the union has taken include:
•Backed anti-MMA legislation in New York;
•Called on the Federal Trade Commission to investigate UFC parent company Zuffa, which the union accused of using monopolistic tactics to thwart competition from other MMA promoters;
•Launched a website complaining that UFC President Dana White swears a lot;
•Launched an online petition calling on FOX to back away from a deal to broadcast UFC events;
•Demand Anheuser-Busch pull its Bud Light sponsorship of the UFC;
•Supported wacky MMA legislation in California;
•Demanded the Marine Corps cut ties with the UFC;
•Demanded that OTM cut ties with the UFC; and
•Asked FOX to remove UFC lightweights Jeremy Stephens and Abel Trujillo from their UFC on FOX 5 fight for having a record.
•Petitioned Toys"R"Us CEO Gerald Storch to pull all UFC related toys from the company's stores.
•Sought to bar minors from UFC Boston;
•Complained that a local gay and lesbian community center is honoring the UFC.

Where organized labor once lifted millions of exploited workers into the middle class, the Culinary Union is now spending member dues to accuse Dana White of swearing. And the union has no issue what so ever with the UFC.

Now, in a editorial, the Las Vegas Review Journal has called for an end to the 'unwarranted attacks.'

Culinary should tap out

For an organization whose membership includes thousands of food service industry employees, Culinary Local 226 doesn’t seem to understand who butters its workers’ bread.

As reported by the Review-Journal’s Yesenia Amaro on Tuesday, the Culinary union sent a letter to the Gay and Lesbian Center of Southern Nevada, asking the organization to reconsider honoring the Ultimate Fighting Championship as corporation of the year. The letter was yet another Culinary attack on UFC majority owners Frank Fertitta III and Lorenzo Fertitta, who also happen to own Station Casinos.

The letter said “the UFC has a history of tolerating offensive comments by fighters and company representatives, including anti-gay and misogynistic remarks.” But this grievance is really about Station Casinos’ nonunion properties and the Fertittas’ insistence on a secret-ballot vote to organize them. To try to make the Fertittas cave to card check, the Culinary intimidates anyone who does business with them or attempts to recognize anything tied to the Fertittas in a positive fashion.

Contrary to Culinary’s statements, the UFC has “had an impressive presence at significant events, and they have ensured that this participation has included the highest levels of leadership of UFC,” said Raymond Wilmer, president of the center’s board of directors. To Culinary’s credit, center Director of Communications Ryan Marquardt said the union has also been supportive. The UFC has donated $200,000 to the center. Mr. Marquardt said the Culinary has not made such a financial contribution.

Union spokeswoman Yvanna Cancela didn’t return calls or email from Ms. Amaro seeking comment, which isn’t surprising. Union leaders can’t possibly defend their strategy. The Culinary would do well to remember that the UFC’s huge mixed martial arts events on the Strip put big money into union members’ pockets and, by extension, the union itself. Kudos to the Gay and Lesbian Center of Southern Nevada for refusing to rescind the honor. Enough of the unwarranted attacks, particularly over noteworthy charitable acts.

Can't stand this union but could you shill any harder for Zuffa?  The bullet points in every single thread, it's getting old.

ROFL the Government does a better job then the unions do. If this was 120 years ago then I would agree with you.

i'll never forget when those Nerds (culinary union) tried calling me wanting me to do some interview with the main objective being, to bad mouth the UFC just because they heard a rumor the UFC wasn't taking care of my medical injury and rehabilitation from the ulner nerve injury in my last UFC fight. I told them to f... off and get a life! You should have heard how nervous this guy name Chris who I spoke to was, when he found out I wasn't going to be dis-loyal to a company I dreamed for well over a decade of fighting for. I love the UFC! do I agree with everything they do. NO. But, I would like to consider myself a little more Loyal that that.

Plus, why would I bad mouth the UFC, when I have my fighters in my gym to think about. It's not all about me. I don't burn bridges. I'm not a fool.

Yes, like all insurance, they can't cover everything ever.

And some have been preexisting conditions and even fighters admittedly not doing paperwork on time.

Grasping at a couple of times when they are covering hundreds daily is weak sauce. And I knock the UFC all the time but not over this.

Unions are a fantastic thing, however the leadership doesn't do much these days to advance the cause of the general worker. It isn't their fault, once Reagan killed the ATC's union in the 80's and effectively outlawed the "strike" they can't do much. So they have turned into a fund raising organization that collects dues that they in turn use to lobby politicians and fund candidacies that promise to never cut back on unreasonable pensions. In CA if you work for 33 years for either the police or fire departments your pension is 90% (just imagine you're fresh out of high school and you join the LAPD. By the time you're 52 you retire with a 90 percent pension that the state has to fund for the rest of your life). That kind of shit just isn't sustainable and rather than negotiate and find a way to ensure that the people who are already drawing a pension can keep theirs while lowering the rate for people who aren't close to retirement, we get politicians who are funded by these unions refusing to talk about it while the state gets closer to bankruptcy. He was talking specifically about his injury and insurance. What does that have to do with any other fighter?

Defending the Culinary Union's practices in this instance is beyond asinine.

You folks that are doing it really need to step back and consider whether your hip, cool "anti-Zuffa" stance is clouding your judgment.

The CU is trying to force the Fertittas into an unwanted business relationship by maliciously turning any unrelated screw they can find.  It'd be as if a car dealership sent defamatory letters to all of your friends and co-workers accusing you of child molestation until you agreed to buy a car.  Or if a contractor quit working halfway through your home remodel until you agreed to pay double the original price for the renovation.

You can argue that car dealerships and contractors are good people or that they serve a useful function in society, but you can't argue that malicious attacks designed only to harass and extort are acceptable.

The way into Station's Casinos for CU is through the workers.  An extensive body of labor law provides the CU with all of the tools they need to advocate to the workers that unionization is in their best interests and to hold a vote on that issue.  But the CU doesn't want to do that . . . because they'd lose.  And if that loss was anything but legitimate, that same body of labor law provides all sorts of ways to challenge the loss in court.  But the CU doesn't want to do that either . . . because they'd lose.

So instead the plan is to ceaselessly try to extort and harass the owners into cooperating with the CU.  That's shameful, and, frankly, boarders on illegal.  I do think that part of the Fertittas' plan is to let the CU twist in the wind until they finally reach heretofore unknown levels of absurdity and "mafia style," at which point the DOJ may even become interested.

The CU has legitimate routes to unionization, and if the workers desire it, they can be successful.  The CU has thus far refused to pursue those routes, and instead chose to go with extortion and harassment.  There's a conclusion to be drawn there.

KingofBJJ -

Unions suck.  Everyone should hate unions and everything they have ever done to those poor trillions dollar congomerate corporations that had to do things such create a safe environment for factory and warehouse employees.  Or actually have to give employees sick leave, vacation pay and for god's sake pay them for holidays and over time?  Overtime?  What's wrong with working 15 hr days six or seven days a week mandatory with no overtime and at whatever pay they want to pay you?  Hey if you get hurt on the job, buddy that's your own ass and you better be at work at 3:00am to be ready work.  Kid is sick?  Too freaking bad, you should have got married.  You are married and the other person is working?  Oh well should have thought about that before you had kids.

Yup thos sucky Unions.  We would have been alot better off letting the companies do whatever they wanted from the begining.

I disagree that unions are responsible for any of those things in modern American society.

The vast majority of companies are non-union, and they don't abuse their workers as you suggest. And that's so because competition for workers prevents it. Workers expect certain benefits, and any company that refuses to provide them will have a difficult time retaining employees.

Unions serve a much more important function when there is no competition for workers--such as in the old "company town" days when nearly every resident in town worked at a certain factory, which was the only source of work in the area.

Because that fact pattern hardly exists anymore, unions are rarely worth the trouble. They cost far more than they're worth for the benefits they provide workers.

BUT . . .

You and I can disagree on that, and it won't matter. The overall value of unions is not the debate at hand.

The debate at hand is whether the CU's approach to dealing with the Fertittas is the right thing for it's membership and adheres to the standard of business reasonableness. On that issue, I think the answer is unequivocally "no," regardless of your stance on unions overall.

Within the framework of the law, unions are routinely able to unionize companies.

The CU has all the tools they need without having to resort to harassment and extortion. The Federal Government itself will be there to enable their efforts.

The CU fails because the workers aren't persuaded. No other reason.

Believing otherwise is believing in the "Easter Bunny." Phone Post 3.0
