How can you face jail time if someone sends you childporn and you inadvertently open it?
In common criminal law there is an intent element; you're not guilty of a crime unless the prohibited act you performed was done with some level of criminal intent. Shooting someone in self defense is a different intent than murder, for example. But a lot of federal criminal laws are "strict liability," meaning your intent is irrelevant and not even considered.
There are state/local laws that are also strict liability, but they are usually low level crimes, like speeding.
I've always felt the federal laws that attach felony consequences to strict liability crimes was a problem. I don't mean in the legal sense as they've been upheld many times. I mean from a government morality sense. A government that would jail you for five years without you having any criminal intent is not a moral one; that is more like something done by a tyrannical government.
That said, fuck Alex Jones, his Sandy Hook conspiracy shit was malicious and mean.
